1. ABOUT THIS PRIVACY POLICY. This Privacy Policy applies to the website owned and operated by PRICEWAND, LLC (“PW"). The "Site" means any website that PW owns or controls. This Privacy Policy is intended to help you understand how PW manages information about you.
By using the Site, you consent to PW’s use of your information as described in this Privacy Policy. PW reserves the right to change this Privacy Policy at any time without advance notice. Should any new policy go into effect, it will be posted on this site, and the revised Privacy Policy will apply only to information collected thereafter. You will be able to determine if this Privacy Policy has been changed since your previous visit by viewing the “Last Updated” information that appears at the top of this Privacy Policy. Your continued use of the Site will indicate acceptance of the changes. You may choose to opt-out by discontinuing your use of the Site. Please exit the Site immediately if you do not agree to the terms of this Privacy Policy or any revised policy. Terms used in the Privacy Policy are defined in the Terms of Use.
2. PERSONALLY IDENTIFIABLE AND NON-PERSONALLY IDENTIFIABLE INFORMATION. While you may use the Site without providing personally identifiable information, some of the Services on the Site require that you provide personally identifiable information. If you use the Site without providing personally identifiable information, the only information PW collects will be non-personal information through the use of cookies or web beacons. If you choose to provide personally identifiable information to PW for certain Services, you are responsible for ensuring the accuracy of the personally identifiable information you submit to the Site. You further agree that PW may copy, use and display personally identifiable information that you submit to the Site where it may be viewed by other Users. You agree to hold PW harmless from the copying, use and display of any such personally identifiable information by PW or other Users. Inaccurate information will affect the information you receive when using the Site and PW’s ability to contact you as described in this Privacy Policy. For example, your email address should be kept current because that it is how PW communicates with you.
You may agree to allow PW to access your profile on certain social media websites, such as Facebook®.
By allowing such access, you agree that you are responsible for ensuring the accuracy of any personally identifiable information contained in such social media profiles. You further agree that PW may copy, use and display personally identifiable information contained in such social media profiles on the Site where it may be viewed by other Users. You agree to hold PW harmless from the copying, use and display of any such personally identifiable information by PW or other Users.
As you use the Site, you will be given the option of receiving recurring informational newsletters via email from PW. In order to subscribe to these newsletters via email, PW will need your contact information, including name and email address. You can unsubscribe from the newsletters by simply following the directions included at the bottom of each email newsletter you receive from PW. If you have difficulties with the unsubscribe or subscribe service, please use the Customer Support Form to write and let PW know about your problem. PW Customer Service will manually unsubscribe you from receiving the newsletter within ten days.
Despite PW’s efforts to protect your personally identifiable information, there is always some risk that an unauthorized third party may find a way around the Site’s security systems or that transmissions of your information over the Internet may be intercepted.
Even if you do not provide personally identifiable information to the Site, PW collects non-personal information about your use of the Site. Your visit to the Site is tracked through a standard web traffic statistics program, which keeps records of traffic on the site, as well as numerical counts of visitors by domain, URL, search engine, keywords used, and other standard web measurements. PW’s server automatically collects data about your server’s Internet address when you visit the Site. This information, known as an Internet Protocol address, or IP Address, is a number that is automatically assigned to your computer by your Internet service provider whenever you are on the Internet. When you request pages from the Site, PW’s servers may log your IP Address and sometimes your domain name. Your IP Address is used to help identify you and to gather demographic information about our customers as a whole, but does not include personally identifiable information. Our server may also record the referring page that linked you to us (e.g., another web site or a search engine); the pages you visit on this Site; the web site you visit after this Site; the ads you see and/or click on; other information about the type of web browser, computer, platform, related software and settings you are using; any search terms you have entered on this Site or a referral site; and other web usage activity and data logged by PW’s web servers.
PW uses this non-personally identifiable information for internal system administration, to help diagnose problems with our server, improve and personalize Services, features, content, advertisements, manage your account, to contact you, to conduct research and review or our Site, to administer the Site and offer you related goods, services and content. Such non-personally identifiable information may also be used to gather demographic information, such as country of origin and Internet Service Provider. PW may link this non-personally identifiable information with your personally identifiable information.
PW may use your personally identifiable and non-personally identifiable information, and allow business partners or affiliates or ours to use it in a manner that is non-personally identifiable, in order to conduct research about use of this Site, user habits and preferences. PW may use personally identifiable and non-personally identifiable information to send you updates and news regarding the Site and to offer you advertisements and promotions on behalf of itself, or its business partners or affiliates. However, PW will not share your personally identifiable information with other parties, except as stated in this Policy, or as specifically authorized by you.
In certain circumstances, PW may provide personally identifiable information or non-personally identifiable information, or both, to third parties that provide PW with technical services, support or other services regarding the maintenance and operation of the Site and its related Services. When PW does that, it will require the third party not to use the personally identifiable information and non-personally identifiable information for any other purpose and not to transfer it to a third party. PW may disclose personally identifiable information or non-personally identifiable information to government authorities, and to other third parties when compelled to do so by government authorities, at its discretion, or otherwise as required or permitted by law, including but not limited to in response to court orders and subpoenas. PW also may disclose personally identifiable information or non-personally identifiable information in connection with investigations or when it has reason to believe that someone is causing injury to or interference with its rights or property, other users of the Site, or anyone else that could be harmed by such activities.
3. LINKS TO THIRD PARTY WEBSITES. The Site may contain links to other websites. Once you enter another website (whether through an advertisement, service, or content link), be aware that PW is not responsible for the privacy practices of these other sites. PW encourages you to look for and review the privacy statements of each and every web site that you visit through a link or advertisement on PW. PW does not disclose your personally identifiable information to these third party websites.
In some cases, when you click on a link or an advertisement on the Site, in an e-mail or newsletter, your browser may be momentarily directed to the website of a third party which, acting on behalf of PW, notes or "counts" your response to the e-mail or newsletter before re-directing your browser to your selected destination; this re-direction process may not be apparent to you.
4. STORAGE OF INFORMATION. PW stores user information, including personally identifiable information, on its servers, which may be located in different countries, or on servers of third parties who provide PW with storage facilities, which may also be in different countries. Any personally identifiable or other information may therefore be used and stored in a country different from yours. PW may use third parties to process information, including personally identifiable information, for itself. PW shall require such third parties to abide by this Privacy Policy. Information is stored on secured servers and shall use its best efforts and industry standard measures, technologies and procedures to preserve the integrity of personally identifiable information and to thwart unauthorized access and use thereof. However, PW cannot guarantee any personally identifiable information against unauthorized access and use by third parties acting maliciously or in bad faith. If PW identifies a security breach, involving unauthorized access of a third party to your personally identifiable information, it shall use its best efforts to notify you of such as soon as is reasonably possible, using the contact information that you have previously provided to PW.
5. INFORMATION YOU SEND TO PRICEWAND. This Privacy Policy does not apply to content, business information, ideas, concepts or inventions that you send to PW by email or otherwise. If you want to keep content or business information, ideas, concepts or inventions private or proprietary, do not send them to PW by email or any other method.
6. CHANGES TO YOUR PERSONALLY IDENTIFIABLE INFORMATION; COMPLAINTS. You may at any time access and modify any accessible personally identifiable information submitted by you (not including email address) by using the Account Profile feature on the site. If you have a complaint or problem, please let PW know by using the Contact Us link on the Site. If you want to (1) delete your personally identifiable information from PW’s systems, (2) update the personally identifiable information that you have provided to PW, or (3) change your preferences with respect to receiving newsletters or other activities, select use the Contact Us link on the Site. Upon your request, PW will delete your personally identifiable information from its active databases and where feasible from its back-up media. Please note that if you chose to modify, or request us to delete any personally identifiable or other information, we may retain copies of the information as originally submitted in order to ensure payment for any Services and as may be required by an order or subpoena issued by a judicial or administrative authority or by a law enforcement agency, or as we may in good faith, consider necessary under law, or upon a request or demand received by us in connection with a legal complaint, claim, suit or procedure. You should be aware that it is not technologically possible to remove each and every record of the information you have provided to PW from its servers.

7. MISCELLANEOUS. This Policy does not govern the collection or use of information by third parties, such as advertisers on the Site. For information on how third parties collect and use information, please consult the Privacy Policies of those third parties. The headings to this Privacy Policy are intended for convenience only and shall not be used for interpretation. If any provision or provisions of this Privacy Policy should be held to be unenforceable, such holding will not affect the other provisions hereof which shall remain in full force. This site is owned and operated by PriceWand, LLC, a Florida limited liability company, and is designed to conform to the laws of the state of Florida. If you are viewing or using this site from another country, please be aware that you will be transferring information outside of your country. Your continued access and use of this site will indicate your consent to this. This Privacy Policy shall be governed and construed under the laws of the state of Florida, USA, without regard to its conflicts of laws. Exclusive jurisdiction over any dispute arising out of or under this Privacy Policy shall be with the state or federal court in Broward County, Florida, USA. You hereby waive any right to file a claim in any other jurisdiction, including forum non conveniens.
